What Is a Letter of Capacity?
A Letter of Capacity is a medical opinion provided by a doctor confirming whether an individual has the mental capacity to make a specific decision at the time they are assessed.
Mental capacity is assessed under the principles of the Mental Capacity Act 2005 and is decision-specific. A person may have capacity to make some decisions while lacking capacity to make others.
Following assessment, a written medical opinion or report can be provided where appropriate.
